Sending a house rental agreement letter to a prospective landlord is a good way to make sure all of the terms and conditions that were agreed upon orally are understood by both parties. If the agreement remains an oral agreement, there is the chance that some landlords may not keep their word. For example, he or she promised to repaint the kitchen when speaking to the prospective renter, but, later, regularly postponed doing it. With a letter, the promises are in writing, so neither party needs to remember the precise details.
Whatever agreement was reached with the landlord can be mentioned in the letter including:

• Length of rental agreement
If the landlord does not dispute any of the agreed upon items listed in the letter during the stipulated time given, he or she will be legally bound to fulfil the agreement. If the case goes to court and that is the first time the landlord disputes the agreement, their chance of winning is slim.
An agreement letter can also work in favor of the landlord. If the tenant demands things that he or she claims were agreed upon orally, the landlord can produce this letter to prove that no such agreement was made.
Another type of house rental agreement is the month to month agreement. The terms of this need not change each month, but they can. This allows landlords to evict tenants after one month if they don’t trust them. It also allows tenants to leave a rental property quickly. A lease is usually the method for renting property for six months to one year at a time. The house rental agreement cannot change during the period of the lease. It is in this case that a house rental agreement letter is beneficial.
Before the renter agrees to terms and conditions for renting a house or apartment, they should understand a few basic rules that will protect both the renter and the landlord.
• If the landlord does not offer a rental or lease agreement with all the conditions clearly stated in writing for both to sign, the renter should send a letter listing the agreements and requiring the landlord to respond within a certain period of time.
• The landlord and renter should agree on the essentials such as amount of rent and deposit, pets, parking and roommates.
• The tenant should be sure they understand all the terms and conditions before they sign anything. They may need the help of a lawyer.
• The tenant should learn their state’s laws about renting and leasing to know if there are any illegal lease provisions in the agreement.
• The tenant should learn the difference between leasing and renting and make sure they are getting what they want.
Here is a sample of a house rental agreement letter. It should be formatted like a business letter to be professional, but the tone need not be formal. The letter should be sent by certified mail, so the renter has proof of the time and date the letter was sent and received. A copy of this and any response should be kept in a safe place in the event there is a dispute over an issue that is covered in the letter, and a court case is filed.
